Reasons for Unacceptable Risks (note risk underwriting is unique to each company and the following is a sample guideline only.(We recommend you speak to your agent or broker to determine your Risk acceptance)
Underwriting Rules for declining New Business, Non-Renewal, Midterm Cancellations and Optional Coverage's
New Business Declinations:
- Incomplete applications Ie
:
- Refusal to authorize the ordering of required reports
- Fails to provide the previous insurers name and policy number
- Applicants gives false or incomplete particulars of the descried automobile
- Applicant knowingly misrepresents or fails to disclose any required fact.
- Failure to pay outstanding premiums owing to company.
- Any vehicle that has been insured for Comprehensive or specified perils coverage only continuously over the past 12 months.
- Where there is failure to repay benefits received under an auto policy to which the insured was not entitled
- One or more cancellations for material misrepresentations or non disclosure in the preceding 3 years
- Failure to promptly notify the insurer of any change in the risk material to the contract That is within the insured knowledge.
- Three or more cancellations for non payment of premiums in the preceding 3 years
- Any applicant /insured or named operator whose current motor vehicle record can not be verified
- One or more convictions for auto insurance fraud in the preceding 10 years.
- One or more criminal code convictions in the prior 3 years.
- Any applicant /insured or named operator who has had a license suspension due to a criminal code conviction in the preceding 6 years
- One or more major conviction in the prior 3 years including operating a vehicle without insurance or making a false statement in the certificate of insurance required for the insurance, validation or transfer of a vehicle permit.
- Three minor convictions in the preceding 3 years.
- Insured contravenes a term of the Automobile insurance contract.
- Two or more at fault accidents in the prior six years.
- One at fault Loss where the principal operator has been licensed for less than 4 years
- One at fault accident in the prior 6 years ,and 2 minor convictions in the prior 3 years
- One at fault accident in the prior 6 years and 1 minor conviction in the past 3 years and I cancellation for non payment of premiums in the prior 3 years
- One at fault accident in the prior 6 years and 2 cancellations for non-payment in the prior 3 years.
- Two minor convictions in the prior 3 years and 2 cancellations for non payment of premium in the prior 3 years
- Insured willfully makes a false statement in respect of any claim under a contract of automobile insurance.
- Risks requiring a liability limit of greater than $2,000,000
- Where the vehicle is not roadworthy or fails to meet government standards.
- Recommendations or terms of acceptance are not complied with by the insured (Ie signed documentation of restrictive endorsements such as OPCF 28 or 28A have not been received) then the risk will be declined.
- Vehicles not registered or not plated in the province of residence.
- Risk where the applicant and or the principal operator does not have a permanent provincial address and residency or is not a resident of Canada and will only be in Canada for a period of less than one year.
- Any risk where the insured is the only operator of the vehicle(s) and whose license is under suspension
- Where any driver who previously signed an excluded driver endorsement (opcf 28A ) and has subsequently been found driving the vehicle.
- A vehicle which is owned by an individual and rented or leased to others
- Vehicle is used for a purpose other than that for which it was designed as a personal use private passenger vehicle (e.g. including but not limited to short term rentals, courier, fast food or emergency response).
- Vehicle is operated on muskeg, bog, or ice.
- Vehicles designed and used for race and or speed tests
- Kit cars and replicas
- Where the behavior of the insured /applicant or named driver is abusive or threatening to the insurer or brokerage staff
and the police have laid the appropriate charge.
Refuse to Renew
Insured knowingly misrepresented or failed to disclose any required fact when applying for a new policy or when requesting a change in the existing policy.
Failure to pay outstanding premiums owing to company
Three or more cancellations for non payment of premium in the preceding 3 years
Any vehicle that has been insured for comp or specified perils coverage only continuously over the past 12 months.

Three minor convictions in the prior 3 years and 2 cancellations for non-payment of premium in the prior 3 years.

Mid Term Cancellations
- Applicant /insured knowing misrepresents or fails todisclose any required fact when applying for a new policy or when requesting a change to the existing policy
- Non payment of all or part of premium.
- Material change in risk
- Any risk where the insured is the only operator of the vehicle and whose license is under suspension.
Reasons for Cancellation
- Non-payment of all or part of the premiums
- Material change in risk
- Any risk where the insured is the only operator of the vehicles(s) , and whose license is under suspension
Reasons for declining of Optional Coverage's
- We may refuse to write other than compulsory coverages under the following circumstances.
- Vehicles that are damaged or unrepaired.
- Risks where the insured has taken cash settlement instead of repairing the vehicle. Physical damage coverage will not be added on again until we have received proof of repairs to the vehicle.
- Vehicles for which parts are no longer available or manufactured.
- Modified or customized vehicles which are not a manufacturer's model:
- Propane powered vehicles (unless factory built and installed for propane use, or certified proof of installation can be provided
- Risk where the vehicle will be operated continuously in the USA for more than 6 months in any calendar year:
- Any risk with a request for an OPCF 19 or 19A without an appraisal:
- Any risk that has developed a frequency of losses under section 7 of the policy. This is defined as four (4) or more occurrences paid or payable under section 7 of he policy in the past 3 years per vehicle. If here have been "at fault" collision losses refer to item 15 or 17 under New Business Declination or refuse to Renew exhibits.
- Recommendations or terms of acceptance are not complied with by the insured (Ie signed documentation of restrictive endorsements such as OPCF8,13C, 16 and 19 have not been received) the risk will be declined or not renewed.
- Minimum deductibles of $500 All Perils or 5% of the vehicle value (whichever is greater), may be applied , and appraisals may be required in the following circumstances
- Vehicles 15 years or older without a current Ministry Safety Standards Certificate and photograph
- Vehicles valued in excess of $100k
- Any driver whose license has been suspended for driving related offence in the past six years ( and note that the length of the suspension will impact the driving record calculation
If an insured has had more than one automobile policy terminated by an insurer for non-payment in the past 36 months, we may not offer a payment plan. If a lapse in coverage has occurred as a result of the insured person's failure to pay the premiums due under a policy the length of the lapse will impact the driving record calculation.
Miscellaneous Vehicles
Risks falling into the above categories are subject to the same rules as shown in the first exhibit as well as the following.
- Principal operator with less than 3 years of driving experience or under the age of 25
Vehicle that has been specially built, altered.changed or modified in any way from the original manufacturers product.
ATV's other than 4 or6 wheelers.
