Acknowledgment and acceptance of terms of service The Lifeinsurancebrokers.com
site is , owned and operated by Lifeinsurancebrokers.com Ltd hereafter
called LIFEINSURANCEBROKERS.COM .
The use of the site is provided to you the (subscriber) under
the terms and conditions of this LIBS.com terms of services and any
operating rules or policies that may be published by LIFEINSURANCEBROKERS.COM
. The LIFEINSURANCEBROKERS.COM service agreement comprises
the entire agreement between subscriber and LIFEINSURANCEBROKERS.COM
and supersedes all prior agreements between the parties regarding the subject
matter contained herein.
By completing the registration process and clicking
the I accept button, you are indicating your agreement to be bound
by all of the terms and conditions of the LIFEINSURANCEBROKERS.COM
service agreement.
Description of service
LIFEINSURANCEBROKERS.COM is providing subscribers with a capability
to send and receive electronic mail(email) via the World Wide Web and on
LIFEINSURANCEBROKERS.COM own system. LIFEINSURANCEBROKERS.COM
will not always charge for this service. Subscribers must (1) provide
all equipment, including a computer, and modem, necessary to establish a
connection to the WWW. (2) provide for own access to the www and pay any
telephone service fees associated with such access.
In consideration for this Service, Subscriber agrees to
- provide certain current, complete, and accurate information about
Subscribers as prompted to do so by the Service.
- maintain and update this information as required to keep
it current, complete and accurate.
All information requested on an original sign up shall be referred
to as initial registration data (IRD). Further more, Subscriber grants LIFEINSURANCEBROKERS.COM
the right to disclose to third parties certain IRD about member and subscriber
membership in the aggregate: However, such disclosures will exclude Members
name, mailing address, email address, account and phone number, unless:
- Subscriber expressly directs LIFEINSURANCEBROKERS.COM or
any other person subscriber may specifically designate to disclose such
information through the service as provided by the service or
- LIFEINSURANCEBROKERS.COM is required to disclose such information
by any applicable law or legal process served on LIFEINSURANCEBROKERS.COM
If any information provided by subscriber is inaccurate, LIFEINSURANCEBROKERS.COM
retains the right to terminate subscriber's membership and rights to use
the service.
Modifications to terms of service LIFEINSURANCEBROKERS.COM may change
the terms and conditions of the LIFEINSURANCEBROKERS.COM service agreement
from time to time, Upon any change in the terms and conditions of
the LIFEINSURANCEBROKERS.COM service agreement , LIFEINSURANCEBROKERS.COM
will notify you by posting the changes as a bulletin at our Broker
Service Support Site. If you agree to be bound by the changes, you must again
click the I accept button that will follow the posted changes, If
you do not click the I accept button , you may terminate your use of the service
at that time.
Subscribers continued use of the service constitutes and affirmative:
- acknowledgment by Subscriber of the LIFEINSURANCEBROKERS.COM
service agreement and its modifications; and
- agreement by subscriber to abide and be bound by the LIFEINSURANCEBROKERS.COM
service agreement and its modifications.
Modifications to Service
LIFEINSURANCEBROKERS.COM reserves the right to modify or discontinue
a service with or without notice to subscriber.
LIFEINSURANCEBROKERS.COM or LIFEINSURANCEBROKERS.COM Ltd shall not
be liable to a subscriber or any third party should LIFEINSURANCEBROKERS.COM
exercise its right to modify or discontinue service.
Privacy Policy
Email is private correspondence between the sender and the recipient.
It is LIFEINSURANCEBROKERS.COM policy to respect the privacy
of its subscribers. Therefore, in addition to the privacy of registration
data as discussed in Section 2 above, LIFEINSURANCEBROKERS.COM will not
monitor, edit or disclose the contents of a subscribers private communications
unless required to do so by law or in the good faith belief that such action
is necessary to
- conform to the edicts for the law or comply with legal process

or
- act under exigent circumstances to protect the personal safety

Subscriber acknowledges and agrees that LIFEINSURANCEBROKERS.COM
neither endorsee the contents of any subscribers communications nor assumes
responsibility for any threatening, libelous, obscene, harassing or offensive
material contained therein, any infringement of third party intellectual
property rights arising therefrom or any crime facilitated thereby.
Subscriber acknowledges and agrees that certain technical processing
of email messages and their content may be required to;
- send and receive messages;
- conform to connecting networks' technical lrequiremetns;
- conform to the limitations of the service, or
- conform to other similar requirements..
Member Account, Password, and Security
Once you have become a subscriber of the service, you shall receive
a password and an account. You are entirely responsible if you do
not maintain the confidentiality of your password and account. Furthermore,
you are entirely responsible for any and all activities which occur under
your account. You may change your information at your (IRD) subject
to address change , phone number , but you cannot change your name or company
name without re-registering.
Subscriber agrees to immediately notify LIFEINSURANCEBROKERS.COM
of any unauthorized use of subscribers account or any other breach of
security know to Member.
Disclaimer of Warranties
Subscriber expressly agrees that use of the service is at subscriber's
sole risk. The service is provided on an ,an is and as available
basis.
LIFEINSURANCEBROKERS.COM expressly disclaims all warranties of
any kind, whether express or implied, including but no limited to the
implied warranties of merchantability, fitness for a particular purpose
and non-infringement.
LIFEINSURANCEBROKERS.COM makes no warranty that the service will
meet your requirements or that the service will be uninterrupted, timely,
secure, or error free; nor does LIFEINSURANCEBROKERS.COM make any warranty
as to the results that may be obtained from the use of the service or as
to the accuracy or reliability of any information obtained through the service
or that defects in the software will be corrected.
Subscriber understands and agrees that any material and or data downloaded
or otherwise obtained through the use of the service is done at members
own discretion and risk and that member will be solely responsible for any
damage to member's computer system or loss of data that results from the
download of such material and /or data.
LIFEINSURANCEBROKERS.COM makes no warranty regarding any goods or services
purchased or obtained through the service or any transaction entered into
through the service.
No advice or information , whether oral or written, obtained by subscribers
from LIFEINSURANCEBROKERS.COM or through the service shall create
any warranty not expressly made herein.
Some jurisdictions do not allow the exclusion of certain warranties,
so some of the above exclusions may not apply to you.
Limitation of Liability
LIFEINSURANCEBROKERS.COM Ltd. shall not be liable for any direct, indirect
incidental, special or consequential damages, resulting from the use or
the inability to use the service or for cost of procurement of substitute
goods and services or resulting from any goods or services purchased or obtained
or messages received or transactions entered into through the service or
resulting from unauthorized access to or alterations of member's transmissions
or data, including but not limited to, damages for loss of profits, use,
data or other intangible, even if LIFEINSURANCEBROKERS.COM Ltd. has
been advised of the possibility of such damages.
Some jurisdictions do not allow the limitation or exclusion of liability
for incidental or consequential damages so some of the above limitations
may not apply to you.
No Resale or commercial use of the service
Subscribers right to use the service is personal to the subscriber.
Subscriber may only be an individual . Subscriber agrees to not resell
or make any commercial use of the service , without the express consent
of LIFEINSURANCEBROKERS.COM Ltd.
Email message storage and other limitations
LIFEINSURANCEBROKERS.COM assumes no responsibility for the deletion
or failure to store email messages.
LIFEINSURANCEBROKERS.COM has set no fixed upper limit on the number
of messages a subscriber may send or receive through the service,
however, LIFEINSURANCEBROKERS.COM retains the right, at LIFEINSURANCEBROKERS.COM
sole discretion, to determine whether or not subscribers conduct is consistent
with the letter and spirit of the LIFEINSURANCEBROKERS.COM service agreement
and may terminate service if a subscriber's conduct is found to be inconsistent
with the LIFEINSURANCEBROKERS.COM service agreement.
Subscriber Conduct
Subscriber is solely responsible for the contents of his or her transmissions
through the service.
Member's use of the site and service is subject to all applicable Local
, Provincial and Federal and international laws and regulations.
Subscriber agrees not to transmit through the service any unlawful,
harassing, libelous,abusive, threatening, harmful, vulgar, obscene or otherwise
objectionable material of any kind or nature. Subscriber further
agrees not to transmit any material that encourages conduct that
could constitute a criminal offense, give rise to civil liability or otherwise
violate any applicable local provincial national or international
law or regulation. Attempts to gain unauthorized access to other
computer systems are prohibited.
As subscriber shall not interfere with another subscribers use and
enjoyment of the service or another entity's use and enjoyment of similar
services. LIFEINSURANCEBROKERS.COM may , at its sole discretion
, immediately terminate service should member's conduct fail to conform
with these terms and conditions of the LIFEINSURANCEBROKERS.COM service
agreement.
Indemnification
Property or other right of any person or entity. Subscriber agrees
to indemnify and hold LIFEINSURANCEBROKERS.COM , its parents, subsidiaries,
affiliates, officers and employees, harmless from any claim or demand ,
including reasonable attorneys' fees, made by any third party due to or arising
out of subscribers' use of the service, the violation of this LIFEINSURANCEBROKERS.COM
service by subscriber or the infringement by subscriber or other
user of the service using subscribers computer, of any intellectual
Termination
Either subscriber or LIFEINSURANCEBROKERS.COM may terminate the service
with or without cause at any time and effective immediately. Termination
shall be accompanied by a written notice to the other party.
LIFEINSURANCEBROKERS.COM shall not be liable to subscribers or any
third party for termination of service.
Should subscriber object to any terms and conditions of the LIFEINSURANCEBROKERS.COM
service or any subsequent modifications thereto or become dissatisfied
with the service in any way, subscriber's only recourse is to immediately;
- discontinue use of the service;
- terminate service membership; and
- notify LIFEINSURANCEBROKERS.COM of termination.
Upon termination of the service, subscriber's right to use the service
and software immediately ceases. Subscribers shall have no right and
LIFEINSURANCEBROKERS.COM will have no obligation thereafter to forward any
unread or unsent messages to subscriber or any third party.
Notice
All notices to a party shall be in writing and shall be made either
via email or conventional mail. LIFEINSURANCEBROKERS.COM may broadcast
notices or messages through the service to inform subscribers of changes
to the LIFEINSURANCEBROKERS.COM service agreement, the service or other matters
of importance, such broadcasts shall constitute notice to subscriber.
Participation in promotions of advertisers subscriber may enter into
correspondence with or participate in promotions of the Advertisers showing
their products on the Service. Any such correspondence or promotions,
including the delivery and the payments for goods and services,
and any other terms, conditions, warranties or representations associated
with such correspondence or promotions, are solely between the corresponding
subscriber and the Advertiser.
LIFEINSURANCEBROKERS.COM assumes no liability, obligation or responsibility
for any part of any such correspondence or promotion.
Proprietary rights to content
Subscriber acknowledges that content, including but not limited to
text, software, music, sound, photographs , video, graphics or other material
contained in either sponsor advertisements or email-distributed, commercially
produced information presented to subscriber by the service(content) by
LIFEINSURANCEBROKERS.COM or lib's advertisers, is protected by copyrights,
trademarks, service marks, patents or other proprietary rights and laws;
therefore, a Subscriber is only permitted to use this Content as expressly
authorized by the service or the Advertiser.
Subscriber may not copy, reproduce, distribute, or create derivative
works from this content without expressly being authorized to do so by
the Service or the Advertiser.
Laws
The LIFEINSURANCEBROKERS.COM service agreement shall be governed by
and construed in accordance with the laws of the province of Ontario ,Canada
excluding its conflict of law provisions.
LIFEINSURANCEBROKERS.COM's failure to exercise or enforce any right
or provision of the libs service agreement shall not constitute a
waiver of such right or provision unless acknowledged and agreed to by LIFEINSURANCEBROKERS.COM
in writing.
Subscriber and LIFEINSURANCEBROKERS.COM agree that any cause of action
arising out of or related to this Service must commence within one(1)
year after the cause of action arose, otherwise, such cause of action is
permanently barred.
The section tittles in the LIFEINSURANCEBROKERS.COM service agreement
are solely used for the convenience of the parties and have no legal or
contractual significance.
The following is the code of ethics and terms of registration
that must be adhered to, or your link and registration to this site will
be terminated.
a) terms of how a lead is to be handled.
once notified of a potential lead by either , phone, fax , or email,
the receiving broker has two (2) business days to contact a lead.
In the event, due to circumstances beyond your control you may attempt to
contact beyond the 2 business days , It is understood the client may have
solicited another broker and the second broker has the first right to service
the client .
Since this site works on the premise of goodwill and fair play, it
is also understood the client has the absolute right to determine
if they wish to continue to work with yourself. if a second broker has contacted
the client due to the fact you were not able to contact the client within
the 2 business day limit , then the second broker shall have the first
right of continuation and you must explain this to the client, again
the client shall make the absolute decision to continue discussions with
yourself or the second agent and both agents must abide by that decision.
in the event a conflict occurs between the first and or subsequent agent
, the client will be the one to decide absolutely which agent or broker
they wish to consummate any further transactions. A broker failing
to abide by this standard will no longer be eligible to be on this site.
A third party arbitrator appointed by this organization, Lifeinsurancebrokers.com,
will have absolute control of that decision and the brokers will abide
by such decision. The cost of such arbitration, if required ,will be
expensed to the brokers in conflict and any collection costs involved in
such decision..
The brokers if solicited by a client to quote a specific company due
to a no obligation quote being generated, are obligated to respect the
wishes of the client and work with the quoted company. As any professional
is expected to do if the product is not in the best interest of the
clients goals , this must be pointed out and if an alternative within that
companies portfolio is available , we ask that the quoted company be given
first opportunity to solve the clients needs. If this is not acceptable
then any and all companies represented by the brokers may be considered
acceptable alternatives if it is in the clients best interest.
The following are standards of conduct expected of all brokers listed
on this site. Failure to abide by any and all of the listed standards may
mean the removal of your listing on this site.
priority of client interests
You are expected to place the interest of clients and prospective purchasers
before your own.
confidential information
respect the confidential nature of all information regarding a client's
personal and business affairs received in the course of providing or attempting
to provide financial products and services.
disclosure
Accurately disclose to a client all material facts relating to any
product which you discuss so that he or she can make an informed decision.
misrepresentation
do not make any false or misleading statement or representation when
providing a Life insurance companies financial product and services to
your clients.
rebating
do not directly or indirectly rebate or attempt to rebate all or any
part of a premium for insurance in contravention of provincial insurance
legislation
replacement
Ensure that any replacement of an existing policy is in the best interests
of the policyholder, complete fully and accurately the required disclosure
statement and comply with any other applicable replacement regulations
or industry holding out to the public
Accurately describe your business, training and qualifications on all
letterhead, business cards, written proposals and advertising.
improper advertising
Do not use advertising which indicates sales attainments or membership
in a club or other organization in which the production of stipulated
volume of business is necessary qualification for membership with the exception
of MDRT status in accordance with the MDRT regulations.
premiums
Unless otherwise agreed by a specific Insurance company,
premiums should be made payable directly to that specific company . Should
you receive premium amounts on behalf of a specific insurance company,
keep accurate records of all premium amounts received and remit all premiums
promptly to the company.
complaints
Inform Lifeinsurancebrokers.com and the respective Insurance company
of any complaint from a policyholder, agent, broker, or regulatory authority
which you receive in respect of your distribution of their products and
co-operate fully with any regulatory inquiry or investigation.
